Research Notes:

James's will was probated in Russell Co, Virginia, 29 February 1804. James Dyer & Ann his wife were mentioned in her father's will in 1765, in the same year James Dyer purchased land on the nap of Reed Creek in Granville Co, N.C.. James and Ann as co-signer bought and sold land in Granville Co, N.C.

James Dyer was listed on the Militia rolls in 1771, Granville Co, N.C. in Capt. William Beauford's Company. In 1778 James Dyer purchased land in Rockingham Co, Virginia, in 1780 he was still listed on the tax rolls of Granville Co, N.C. for 6,228 pounds assessment. In 1785 James Dyer sold the land that he lived on in Granville Co, N.C., his wife did not sign, she may have died prior to this date.

On the 11th. of Nov. 1788 James Dyer of Orange Co, N.C. purchased 330 acres on both sides of Hogans Creek, this was witnessed by Elisha Dyer.

In 1803 James Dyer sold all his land in Rockingham Co, Va. between January and June. On the 1st of August 1803 James Dyer's Will was probated in Russell Co, Virginia.

JAMES DYER'S WILL

I, James Dyer of Russell County and the State of Virginia hereby make my last Will and Testament in manner following that is to say; first I desire that out of my money my just debts and funeral expences to be paid out of the money in hand and all that is owing to me and the balance if there be any left I give to my sons Elisha and Baldy and the living stock horse cattle so forth to be sold and the money arising therefrom to be divided between Elisha and Baldy. Secondly I give a negro girl named Suky to my daughter Linna. Thirdly I give negro boy named Luke unto my son William and Willy to be equally divided between them two and if they cannot agree for them to sell the negro and divide the money equal. Fourthly, I give my bed and furniture of the bed and pots and pewter to my son William my daughter Linna to be equally divided between them two as they please save one big pot to William. Fifthly I give of nine acres of my land to my daughter Linna the land to be down on the river joining a white walnutcorner and running up the river for quantity. Sixthly I give the remains of my land which is 195 acres to my sons William and Willy giving William eighty four acres to be divided according to the quality and divided as they please and if they cannot agree John Fugit and Littleberry Robinson to divide it agreeable to the mention quantity and quality and they to abide to it. Seventhly, all the rest of my estate both real and personal of what nature or kind whatsoever it may be herein particularly disposed of, I desire may be equally divided among my several children as herein before named which I give to them their heirs executors Administrators and assigns forever. And lastly I do hereby constitute and appoint my Trusty friend John Fugate and executors of this my last will and Testament hereby revoking all other wills or testaments by me heretofore made.

In witness whereof I have hereunto set my hand & affixed my seal this 1st day of August one thousand eight and three.

Howard and Linna (Dyer) Cash lived in the same neighborhood as Baldy Dyer, Samuel Dyer and William Dyer, all being in the company of James Cole's militia, the tax list was taken by Thomas Bounds.

The son Baldy Dyer , b, ca, 1775, married first to Sophia _______, and second to Mary Taylor on 13 Dec. 1800 in Davidson Co, Tn. Baldy died in November of 1814, while serving in the War of 1812, his married heirs were Willie, James, William, David, Susanna, Simpson and Mary Dyer of Davidson County, Tennessee.

I have never found any traces of the above children, nor anyone who claims to be a descendant of this line. Therefore it is very highly probable that several of the Dyer's of White & Jackson County, Tn. may have been directly related to Baldy Dyer. I believe that two of the children of Baldy and Sophia are Archibald Dyer and Samuel Linn Dyer.

This family is reconstructed from the Family Bible of Wiley Dyer's son Edwin Dyer of Rome, Ga., and Hill Co, Texas Cemetery records.

Wiley Dyer made salt in Lawrence Co, Ky. until 1825, he then moved to Walker Co, Ga.

In a book of biographical sketches of prominent lawyers of Arkansas, Melvin Nathaniel Dyer states that his grandfather, Wiley Dyer, moved fifty three times during his life time. His son Edwin was born in Georgia; James Harrison and Polly were born in Kentucky. Wiley Dyer owned and operated salt mines and other property in Lawrence County, Kentucky, but his real home was in Georgia, near Lafayette. The family traveled between the two places often, and Edwin told his children that his mother's only fear was that the Indians might capture her and scalp her for her long blond hair! (The article below extracted from Watson Dyer's family history publication.)

Records of land transactions in Kentucky lend support to Melvin N. Dyer's statement that his grandfather came to Texas in 1839. Family tradition says that he made several trips to Texas and that he bought land on the Brazos for each of his sons. Since court records in this section have been burned this cannot be verified. We do know that he brought his slaves to Texas to build a home and started back to Georgia, in 1847, to get his family. One story says that he died after eating some frozen turnips he had pulled from a patch he passed. The other says that his horse stumbled and his gun went off, killing him. No matter which tale is true, he did die and was buried beside the trail near the present town of Dangerfield, Texas.

In Smith County, Texas we find records of a suit brought by John Adrian to settle the estate of his father-in-law, Wiley Dyer. In 1842 a land grant had been made to Skelton Bradley who sold it to Wiley Dyer before he recorded his patent. Dyer did not record his deeds, and to clear the title, Adrian had to sue for administration of Bradley's estate - he having died, also. In application, Adrian gave 1847 as the year of Wiley Dyer's death. We do not know when Nancy died, but her name has not been found on any 1850 census record.

No administration of the Georgia estate of Wiley Dyer can be found because Walker County Court House burned. In one deed recorded later, however, we learn that Edwin Dyer sold some of the property to his uncle, Thomas Pullen while acting as administrator of the estate.

Wiley and Nancy (Woolbright) Dyer had eleven children, and fortunately, Edwin recorded the records of his father's family in the big sheep-skin bound Bible that is now in the possession of his grand daughter, Mrs. Robert Kennard of Rome, Georgia.

How the Dyers related to Archibald and Rutha came to Texas

This is my theory. I have researched and can find no other Dyers connected to the two son’s I believe belong to Rutha Johnston and Archibald Dyer. One son named Robert married a Mary Harkrider in McMinn County Tennessee in 1849. Nothing can be found of Robert and Mary after that record of their marriage and they do not appear in any census reports in any states. It could be that they died on the way to Texas to meet up with their family already in Texas. Dyer did not record his deeds, and to clear the title, Adrian had to sue for administration of Bradley's estate - he having died, also. In application, Adrian gave 1847 as the year of Wiley Dyer's death. We do not know when Nancy died, but her name has not been found on any 1850 census record.

 

No administration of the Georgia estate of Wiley Dyer can be found because Walker County Court House burned. In one deed recorded later, however, we learn that Edwin Dyer sold some of the property to his uncle, Thomas Pullen while acting as administrator of the estate.

 

Wiley and Nancy (Woolbright) Dyer had eleven children, and fortunately, Edwin recorded the records of his father's family in the big sheep-skin bound Bible that is now in the possession of his granddaughter, Mrs. Robert Kennard of Rome, Georgia.

Owen died in Kentucky and Jacob Woolbright Dyer died in Georgia.

 

My only problem is finding where Rhoda Susannah Dyer was in 1850 with a certainty. She was a Reynolds when she married Isaac Newton Reeves in Itawamba, Mississippi in 1852 and was probably widowed shortly before that time. The 1860 Census shows them with no Reynolds children in their household, so I am thinking she never had children in her first marriage. She only had one child, Mary Elizabeth Reeves (married William Ussery), and most probably had fertility problems. The marriage record is transcribe as Rody L. Reynolds and Isaac N. Reeves so the L could have been a strange S and that explains the misspelling, but there is no mistaking the last name she bore. The marriage date matches exactly to the date given in her obituary and only the county name is different, but Itawamba is the county in which the Reeves family was living. The 1860 Census shows them living in Yazoo County, Mississippi. Here is the obit:

What became of James puzzles me. I find a Sarah Dyer marrying a Phillip D. Wall (Wahl) in 1858 in Red River County where the brother of Sarah Ann Cooper moved to and raised his family. I believe this is the widow of James Dyer, son of Ruth and Archibald Dyer. Again, I can find no record of what became of them. Some of my Dyers are pretty slippery in finding. There have been all kind of contortions of the name from Syer, Dyre, Dier, Dwyer, Doyer. Deer. I’ve tried every name possibility but may never find them. One that really was a puzzle was find the James Dyer who lived in McMinn with Archibald and Ruth and was a cousin. I couldn’t find him in 1850 at all then Shelia Munden found them and their last name was transcribed Vyes.

I am beginning to think maybe Archibald might have died somewhere along the way to Texas with Rutha and the children, or possibly in Harrison County, Texas after they arrived. We cannot be certain of when they arrived inHarrison County, only that they were there for the 1850 Census. Another comment about the Census records of Harrison County: The Census recorder was totally out of his league. Most records I have found that were done in 1850 and 1860 by this Johnston fellow (most probably related to Rutha Johnston Dyer) contain first one or two initials and then the last name. I Nancy Dyer, do make and publish this as my last Will and Testament, hereby revoking and making void all other by me at anytime made.

First - I direct that my funeral expenses and all my debts be paid as soon after my death as possible out of any money that I may die possessed of, or may first come into the hands of my executors.

Secondly - I give and bequeath to my three sisters; Arabella Dyer, Mary Dyer and Sarah Dyer jointly all my property both real and personal, as well as any money or debts I may be possessed of at my death.

Lastly - I do hereby nominate and appoint my three sisters, Arabella, Mary and Sarah my executors, and direct that my said executors shall not be required to give any security when they take upon themselves the execution of this Will.

We do not know much about the educational advantages given to his sons by Wiley Dyer,

but they all wrote beautifully, were evidently well - read, and took active part in church and

olitical activities wherever they lived. Simpson Cash was no exception.

 

Simpson Cash Dyer may have made earlier trips to Texas, with his home, since John

Adrian, James H. Dyer, Wiley Meeks Dyer, and Harvey Lafayette Dyer were the only ones

concerned in the settlement of the estate in Texas. The grand-daughter of Reverend

Edwin says that the other children received their share from the Georgia property, but

urned court records prevent verification.

 

Simpson Cash was living in Cherokee County, Georgia when the 1850 census of the state

was taken, and he represented the county in the State Convention in 1850. He served in

the House of Representatives from Cherokee County in 1851 and in 1852.

Soon afterwards he joined his brother James in Hill County, Texas. His first Hill County deed

is dated January 2, 1855.

In 1854 James Harrison and Simpson Cash Dyer went to Austin

and secured from Gov. Houston permission to dam the Brazos River to furnish more

power for the flour and grist mill they had built. It reads thus:- " They are

hereby authorized and allowed the privilege of owning and constructing a milling-

dam across the Brazos River, at the present location of said mill, south of Ft. Graham,

on said river and on the western boundary of Hill County, with the executive right of

one mile above and one mile below said mill, provided that the dam shall not interfere

with navigation of said river." A large mill-wheel of solid bronze had been imported

from France and brought up the river to Liberty by boat and overland by ox wagon.

About 1863 a four-foot rise in the river destroyed the dam and the second one was built.

In 1860 a carding machine was added to the mill and in 1866 a gin was constructed -

in keeping with the increasing sheep-ranching and cotton farming in the community.

Dyer was a Godly man and never allowed any mill work to

be done on Sundays - the mill closed at 12:00 Saturday night and began running again

at 12:00 Sunday night. Drunkards and lawless men who harassed the country

side respected the two mile executive rights of the Dyer brothers and stayed outside

those limits! More than fifty people were regularly employed during the operation of the

mill, even after the death of Simpson Cash when it was ran by Thomas Hill who

shared ownership with Adam Powell and John Dyer. (above article from some

In 1850 James Harrison Dyer was listed in the Henderson County census with his wife Amanda and three - year old daughter, Harriet. He moved soon afterwards to what is now Hill County - it is said that Wiley Simpson was the first white boy born there. When the County was first organized, James Dyer became the first County Judge and served in that capacity for a number of years. One biographical sketch says that he was kind and just to his friends but stern and unrelenting toward his enemies.

In 1854 James Dyer received from the state a grant of land within the limits of Charles Fenton Mercer's Colony, having proved to the Court that he had settled within the limits of the Colony prior to the 29th day of January, 1849. In that same year he and his brother Simpson Cash were given a permit to build a dam across the Brazos River.

In the early 1850's James Dyer drove the first herd of cattle from Texas to Chicago. Since this was before the days of packing houses there, he butchered the cattle and sold them to the public. There were eighteen hundred head and the job took a year and a half!

In 1866 when his nephew Frank McMullan organized a colony to settle in Brazil, the Judge was one of the most influential men in the group. ( A very interesting account of this colony was published by E. N. McMullan in the SEMI-WEEKLY FARM NEWS on January 25th, 1916). On April 30, 1868 Judge Dyer's daughter Hattie married Columbus Lee Wasson, and on July 4, 1869 Amanda Webb Dyer died. Within a few years James Dyer returned to Hill County where he served as United States marshall for a number of years and operated ranches in the district. Sept. 1, 1872 he married Evaline Virginia Pierce, his first wife's niece.(his first wife' niece. Has been marked thru in my copy, indicating that perhaps this is an error. R.P.) To this union was born one son (Sledge. (A hand written note inserted here; " John Sledge, I have his baby dress, born Nov. 24, 1878" R.P.)

James Harrison Dyer died in October (October marked out, changed to " Sept." R.P.) of 1900. (The year 1900 marked thru and changed to "1901" R.P.) Eva Pierce Dyer lived until January 14, 1934 and is buried in Dublin, Texas.

He was born in Kentucky on Nov. 13, 1821 (13 marked thru "3" inserted R.P.) and came to what is now Hill county about 1850, settling near Hillsboro. Through his efforts the county of Hill was organized and he served as the first county judge. He was known by almost every man, woman, and child in Bosque and Hill counties, and having no enemies was loved by all.

For a number of years he was superintendent of the Stein Valley prison farm and had all classes of people to deal with, yet he proved a father and friend to all. During the past ten years he has resided on his ranch near Morgan.

Four children mourn the loss of a dear father, James E. Dyer of Corsicana, Wiley near Whitney, Sledge near Morgan, and Mrs Wasson of Gale, Texas.

Wiley Simpson (b. 5-3-53) ("53 marked out 52 written in"R.P.) was the first white child born in Hill County, which had been created from Navarro earlier that year. He was about thirteen when the family moved to Brazil. After his mother's death, he was placed in a native school but rebelled when he was told to bow before the statues of the saints. He had been reared in a good Baptist home and he said bowing to statues was idol worship. When informed that the saints were real, he said he would bow if one of them bled when he pierced it with his knife. As a result, he was suspended and his father continued his instruction at home. This suited Wiley very well, for it gave him more time to roam the strange forests and watch the monkeys and tropical birds. He was about nineteen when Judge Dyer and many of the other colonists returned to Texas. On February 21, 1877, Wiley Simpson Dyer married Nancy Rosella, daughter of S. T. Hill of Bosque County. He was a successful farmer and stockman, and was active in working for better marketing conditions in his community and in improving the breed of stock raised by the ranchers. Too, he had inherited from his father a keen interest in civic affairs and in philanthropy. On March 17, 1901 Nancy died; and on July 19, 1903, Wiley married the widow of Charles Swilling. He died on September 10, 1921 and was buried in Towash Cemetery.

It is my belief that John W. Estes went to a veterans home and died there in 1924. He is seen inmate in the Census of 1920 in Travis County. In 1880 Emily Melvin was living with a Pruitt and in 1891 from the 1900 Census info she married him and became Emily Melvina Pruitt. The Pruitts lived in the same area where John W. and Emily Melvina Estes were living in the 1870 Census. There is no substantiation that this is our John Estes, but he states on the 1920 Census where his parents were from and where he was born and it matches closely. Also found a Census on John Estes as a partner with another man one county over from Emily and he states his marital status as divorced in 1880. From speaking with some of his descendants I learned that he was a wife beater and a womanizer and that's why Emily Melvina Dyer divorced him in1879.

GEORGE WASHINGTON DYER was born on the 16th of January 1813 in White County, Tennessee. George moved to Platte County, Missouri where he is was first noted as a tax payer in 1839 along with his brothers James and John. Their movements appear to be a little unusual, as we find George and John along with their brother Jefferson in the 1840 Pike County, Missouri Census, Pike County being on the opposite side of the State on the Mississippi River. By 1850 George was back in Platte County and was living in Marshall township, his first wife had evidently died, residing with him were his two daughters, and Elizabeth Lawson age 55 born in Virginia, and Thomas J. Wallace age 10 born in Missouri. There is a marriage record in Platte County between George W. Dyer and Mrs. Elizabeth Lawson on 27 November 1883. George lived near the town of Latan where he was one of the first members of the Bee Creek Cumberland Presbyterian Church in 1851. In the 1877 plat map of Platte County George had a 160 acre farm located a short distance East of Latan. Though George may have been the father of more children, I only have a record of these:

6 Nov. 1901, Death of a Pioneer, Mrs Jane Dyer of Douglas Co, expires while visiting her daughter in Medford. Mrs Jane Dyer, a pioneer of Douglas Co, died yesterday morning at the home of her daughter, Mrs N. E. Woods in E. Medford after several months illness, age 75 yrs. She had been visiting since April with her two daughters Mrs N. E. Woods and Mrs A.M. Woodford. Mrs Dyer was born in White Co, Tn. in 1826 and was married to Jefferson Dyer in 1841. They crossed the plains in 1865, settling in Douglas County the same year, where she has since lived. She is the mother of 13 children, 12 of whom are living, all in the Rogue River Valley, with the exception of one daughter, Mrs Tom Stiver of Portland. The remains were taken to Riddle, Oregon on this evenings train, for interment. Jefferson Dyer died in 1886 in Riddle, Douglas County, Oregon.

Mrs Jane Dyer, a pioneer of Douglas Co, died yesterday morning at the home of her daughter, Mrs N. E. Woods in E. Medford after several months illness, age 75 yrs. She had been visiting since April with her two daughters Mrs N. E. Woods and Mrs A.M. Woodford. Mrs Dyer was born in White Co, Tn. in 1826 and was married to Jefferson Dyer in 1841. They crossed the plains in 1865, settling in Douglas County the same year, where she has since lived. She is the mother of 13 children, 12 of whom are living, all in the Rogue River Valley, with the exception of one daughter, Mrs Tom Stiver of Portland. The remains were taken to Riddle, Oregon on this evenings train, for interment. Jefferson Dyer died in 1886 in Riddle, Douglas County, Oregon.

(F) MARY CATHERINE DYER was born about 1852 in Platte County, Missouri, she married G.W. COLVIG.

(G) SOPHRONIA DYER was born about 1854 in Platte County, Mo, she married J. A. JENNINGS.

(H) ELIZABETH DYER was born about 1855 in Platte County, Mo, she married ALONZO WOODFORD.

(I) VIRGINIA ALICE DYER was born about 1859 in Platte County, Mo.

(J) THOMAS DYER was born about 1861 in Kansas, he married HATTIE STERNS.

(K) WILLIAM DYER was born about 1864 in Kansas, he married DELLA PARKER.

(L) SUSAN DYER was born about 1866 in Oregon, she married JAMES CLEMENTS.

(M) LUCY DYER was born about 1868 in Oregon, she married THOMAS STIVER.
